Seafood Suppliers and the Antitrust Laws: Takaways from the Tuna Cases

In the latest turn of antitrust prosecution against tuna canners, StarKist & Co. has agreed to pay at least $50 million as a penalty for violation of the Sherman Act antitrust law, which fine may be up to $100 million. StarKist and other major tuna canners are dealing with alleged price fixing litigation brought by customers, including grocers and wholesalers. We will discuss:

  • The history of the antitrust litigation against the tuna canners and what it means to the credit team
  • Antitrust Laws (from the Sherman Act to the Robinson-Patman Act) and the Credit Department in the Internet Age
    • Pre-sale investigation: gathering information about the customer, including the exchange of credit information
